Susan advises on both contentious and non-contentious employment issues.

Susan’s advisory work includes: individual and collective redundancies and corporate restructurings; employment law issues in commercial transactions, including transfer of undertakings arising from mergers and acquisitions and outsourcing arrangements; harmonising employee benefits and entitlements; a broad spectrum of compliance issues, including drafting employment contracts, grievance and disciplinary procedures, drafting and updating staff handbooks, HR policies and codes of conduct and providing employment law training.

Susan has represented clients in contentious employment disputes, including unfair dismissals, constructive dismissals, discrimination claims, bullying claims, trade disputes and employment injunctions before the High Court and all employment law fora including the Workplace Relations Commission. She has significant experience in resolving complex employment disputes, including senior executive terminations, negotiating severance packages and drafting compromise agreements. Susan has also dealt with a wide variety of commercial litigation matters.

Susan is a member of the Law Society’s Employment & Equality Law Committee and has tutored on employment law and civil litigation on the Law Society’s Professional Practice Course and also a member of the Employment Law Association of Ireland and the Dublin Solicitors Bar Association.

Experience

  • Providing ongoing advice to Irish and international HR managers on both general and specific employment matters, including employer liability, all forms of employee claims, including unfair dismissal, discrimination, personal injury claims and advising on management of stress, harassment, and equality issues in the workplace, advising on complex grievance and disciplinary processes, internal investigations and managing contentious terminations.
  • Advising in relation to obligations on national and multi-jurisdictional transfers of undertakings and outsourcing projects.
  • Advising on individual and collective redundancies in the context of national and international restructurings and business closures.
  • Providing strategies and solutions to businesses seeking to implement changes to key contractual terms and work practices.
  • Negotiating and drafting severance agreements in the context of redundancies and contentious dismissal situations.
  • Advising on various aspects of business disputes involving employee directors and shareholders.
  • Advising on all aspects of employment law arising from international mergers, acquisitions, restructuring, harmonisation and compliance projects.
  • Working across departments in carrying out due diligence work on employment aspects of both asset and share sales.
  • Providing diverse portfolio of national and international employers with advices on the development and updating of employment policies and practices, including general and specific compliance and HR audit issues.
  • Advising clients in relation to rights and duties, including drafting and amending recruitment procedures, employment contracts (from offer letters setting out terms and conditions of employment to complex service agreements incorporating post-termination restrictive covenants, bonus, incentive and retention arrangements, management buy-out clauses, mobility clauses, sabbatical agreements, secondment arrangements), employee hand-books, and codes of conduct to take account of legislative, HR and IR practice developments impacting on the workplace.
