Update - Issue 21 - Spring 2008

Welcome
From Hugh Garvey, Managing Partner.
Better Safe Than Sorry Sub-Prime Lenders under the Microscope
The Health and Safety Authority ("HSA") has made it clear that it will prosecute directors and managers who fail to manage health and safety issues in the workplace. Now the HSA has issued guidance to company officers on how to comply with their legal obligations. Jennifer Clarke reports. The fallout from the sub-prime lending crisis in the United States has led to a credit squeeze on a global scale. Here at home, the government has moved to regulate non-bank lenders and to strengthen consumer protection.
A Trail of Discovery Directory Inquiries
Discovery of documents is an essential tool in all but the simplest forms of litigation. Both sides are obliged to make available all documents, including those that may damage their own case or indeed help their opponents' case. Mike Kavanagh reports. Since it came into force in August 1991, section 150 of the Companies Act 1990 has become an increasingly important piece of legislation that company directors must bear in mind when carrying our their responsibilities, as Hugh Garvey explains.

The recent Budget did not eliminate capital allowances for investors in developments such as hotels - at least in the immediate future. But an astute developer would be wise to plan ahead and to consider the options available on the expiry of the tax life of a given project, writes Gerry O'Hanlon.
Thinking Ahead
The impact that early leavers have on a pension scheme can often be overlooked. This is becoming of increasing importance as individuals may move job many times during a career. Fiona Thornton examines the issues.
